Terms of Service

These Terms of Service ("Terms") govern the use of services provided through Imaginex ("Application"), developed by Studio Arqon. By downloading or using the Application, you agree to these Terms.

1. Service Definition

Imaginex provides AI-powered visual generation and editing services based on images uploaded by users or inputs provided. The generated content is illustrative in nature and may not exactly correspond to real persons, objects, or events.

2. User Account and Identification

Users are required to authenticate using Sign in with Apple in order to access the Application.

Users log in securely through their Apple ID. The Application may use a unique identifier provided by Apple to recognize and associate user data.

The user's email address may be shared as a real or anonymized relay email, depending on Apple's privacy settings.

These identifiers are used to associate generated content and purchases with the user.

Imaginex does not access or store your Apple ID password. Authentication is securely handled by Apple.

3. Content Upload and Responsibility

Users confirm that they own or have the necessary rights and permissions for any content they upload. Users are solely responsible for any violations of third-party rights, including copyright, privacy, or other legal rights.

4. Content Storage

Uploaded images are not permanently stored and are deleted after processing. AI-generated images may be stored and associated with the user for later access.

5. Intellectual Property Rights

All rights related to the Application, including software, design, trademarks, and content, belong to Studio Arqon or are used under license. These may not be copied, reproduced, or distributed without prior written permission.

6. Disclaimer of Warranties

The Application is provided "as is" and "as available." Imaginex does not guarantee uninterrupted, error-free, or fully reliable service.

7. Limitation of Liability

To the maximum extent permitted by law, Imaginex shall not be liable for any indirect, incidental, or consequential damages. Total liability is limited to the amount paid by the user for the relevant service.

8. Service Changes

Imaginex reserves the right to modify, suspend, or discontinue any part of the Application without prior notice.

9. Applicable Law and Jurisdiction

These Terms are governed by the laws of Türkiye. Istanbul Courts and Enforcement Offices have jurisdiction over any disputes.

10. Subscriptions and Payments

Imaginex offers auto-renewable subscription options ("Imaginex Pro") that provide access to premium features.

• Subscription periods may be weekly or monthly
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel your subscription at any time via your App Store account settings
• Prices may vary by region and are displayed within the Application before purchase
